Terms and Conditions (T&Cs)

1. Scope and Provider

These terms and conditions govern the contractual relationship between the operator of Mallorca-Zero, Christian Donnert (hereinafter "Provider"), and the users (hereinafter "User") of the online platform. By registering or using the services, the user agrees to these terms.

2. Description of Services

Mallorca-Zero is a regional online marketplace that focuses exclusively on offers and requests related to the island of Mallorca. The Provider merely provides the technical platform on which users can create and publish advertisements. Contracts initiated through these advertisements are concluded exclusively between the respective users. The Provider is not a party to the sales contracts concluded between users.

3. Registration and User Account

  1. The use of certain functions (e.g., posting ads) requires registration. There is no legal claim to the conclusion of a usage contract.
  2. The user is obliged to provide truthful information and to keep their data up to date.
  3. Each user may only create one user account. The registration of multiple accounts is prohibited.
  4. Access data must be kept secret and may not be passed on to third parties.

4. Principles of Ad Posting and AI Usage

  1. Regional Reference: Only advertisements that have a direct reference to Mallorca are permitted. Offers for real estate, jobs, or services outside of Mallorca are not allowed.
  2. AI Optimization: The Provider is entitled to automatically translate ad content (e.g., via DeepL/OpenAI) and optimize it for search engines (SEO). The advertiser remains responsible for the accuracy of the content.
  3. Copyrights: The user warrants that they hold all rights to the published texts and images. The use of third-party photos (e.g., copied from the internet or stock photos) is prohibited.

5. Prohibited Content and Activities

It is prohibited to publish advertisements that violate legal regulations, third-party rights, or public decency. In particular, the following content and actions are not permitted:

  • Broker Inquiries: Real estate search requests by real estate agents or commercial intermediaries (e.g., "Searching for properties for my clients"). Search requests in the real estate category are reserved exclusively for private end-users.
  • No Mallorca Reference: Advertisements without a direct regional reference to the island of Mallorca.
  • Multiple Listings: Posting identical or equivalent advertisements (duplicates), including the use of different categories or email addresses.
  • Third-Party Listings: Placing advertisements on behalf of third parties (proxy advertisements).
  • Unfair Advertising: Pure advertising for external websites, especially e-commerce shops, auction portals, or business directories.
  • Multi-Level Marketing: Offers for work-from-home, network marketing (MLM), pyramid schemes, or dubious financial investments/loans.
  • Erotica & Youth Protection: Erotic offers and requests of any kind, as well as pornographic or harmful content for minors.
  • Gambling: Competitions, betting, lotteries, or other gambling offers.
  • Quality Deficiency: Insufficiently described offers or advertisements that merely contain a link to an external website without describing the product/service itself.
  • Abusive Communication: Insults, discrimination, racist remarks, as well as public warnings, calls, or reviews directed at other users or companies within the advertisement text.

6. Rights of Use and Indemnification

  1. By posting content, the user grants the Provider the right to make this content publicly accessible and to distribute it on the platform and associated channels (e.g., social media).
  2. The user indemnifies the Provider against all claims asserted by third parties due to the violation of their rights by the content posted by the user. This also includes the costs of necessary legal defense.

7. Changes to Ad Content and History

  1. The advertiser is entitled to change, supplement, or delete the content of their advertisement at any time as long as the advertisement is still active.
  2. A change to the advertisement text after an agreement has already been reached between buyer and seller does not affect the validity of the contract already concluded.
  3. The operator reserves the right to store versions of the advertisement internally (history) in order to be able to provide information in the event of suspected legal violations. The user has no claim to the disclosure of this history.

8. Fees and Paid Services

  1. Basic use of Mallorca-Zero is free of charge.
  2. The user has the option to purchase paid additional services (e.g., ad highlighting) via the integrated shop.
  3. Conclusion of Contract: A contract for paid services is only formed when the user clicks the "Order with obligation to pay" button (or a similarly clear label) in the shop.
  4. Billing is handled via the payment service providers offered (e.g., Stripe, PayPal). The user receives an invoice via email or as a download.

9. Sanctions and Digital Domestic Rights

  1. The Provider reserves the digital domestic right. In the event of violations of these terms (especially point 5) or in the event of justified suspicion of abuse, the Provider is entitled to delete advertisements without prior notice and to block user accounts.
  2. There is no legal claim to the use of Mallorca-Zero.

10. Limitation of Liability

  1. The Provider assumes no guarantee for the accuracy, completeness, or timeliness of the content provided by users.
  2. The Provider is not liable for the constant availability of the website or for technical disruptions outside of its sphere of influence.
  3. The Provider is only liable for damages in cases of intent or gross negligence.

11. Final Provisions

The law of the Federal Republic of Germany applies. Should individual provisions of these terms of use be ineffective, the effectiveness of the remaining provisions remains unaffected. The Provider reserves the right to change these terms at any time.
